My wife moved out while I was deployed can she stop the divorce?

My wifed moved out and took every thing while i was deployed in Iraq, now she says she won’t sign the divorce papers. can she do that and stop the divorce in Texas?

Go to your JAG for help.
She might be able to postpone it, but not stop it.
She has a certain amount of time to respond to the paperwork.
Make sure it is send certified receipt expected.

If you file the paperwork and send it by registered certified mail she has like 28 days to contest it. If she does nothing then you get the divorce by fault. Go to JAG… they should help you with this shit. … yay.. fta.

You need to speak to a lawyer. When there is a divorce threatened, whether it happens or not, both parties have to have lawyers. Who thinks this is a do-it-yourself project?
If she refuses, you can file a motion to the court for a default order.

No, she can’t stop the divorce. She can certainly delay the proceedings a bit, but not stop it entirely against your will.
Get a lawyer, and make sure you have all the proper paperwork filed. Once she has been served, generally she has a month to respond to the petition. If not, you can be given a divorce by default – since she’s choosing to ignore the order to come to court, you will be given the divorce. Separation of property, custody of children, and spousal support will all still be left to sort out, but you can end your marriage pretty quickly, even if she refuses to sign the paperwork.
She doesn’t have to sign. If she does sign you will get the divorce by agreement. If she doesn’t sign then you will get the divorce by no-fault and the expiration of the date for her to sign. Check with JAG and they will walk you through the process.
