In the divorce degree I am to stop paying child support at age 18 or after child graduates?
I live in Illinois, my divorce decree clearly states that either at age of 18 or after high school graduation I am no longer obligated to pay child support. My question is do I have to obtain a certain legal document or go back to court to end the support payments at that time? Or can I cease payments after my child’s graduation without any legal actions?

I think if your child remains living at home and goes to collage you have to still pay . Im not sure each state is different
I’d stop paying
You will need to show that the child either turned 18 or graduated. Which ever comes last and give that to the court so they end payments.
They end automatically. There is a date which is the child’s 18th birthday. It doesn’t go with graduation it’s percise….the 18th birthday..
But know this….as a parent…….it doesn’t end when they are 18. By court standards it does. But by Parent Standards it won’t. In fact, it’s actually more expensive because the grown child now does things that are much more expensive in life. Not like buying a skate board, or school clothes now we are into rent, cars, I’m in trouble w/child support issues…see what I mean. But by court standards yes it’s 18th birthday.
I would run this by your lawyer first (or the court). When I sent the final payment I would include a letter stating that "according to our divorce agreement" this will be the final payment of child support. Send it return receipt or in some other fashion that requires them to sign for it.
It depends on the siuation and what your child does when they are 18.
If they go to college or university you have to continue paying child support. If they are no longer living with the other parent or don’t go to college support payments are terminated.
Unless your wage is being garnished by a child support agency you can simply stop paying (you may need to take an additional step otherwise). Since there is the stipulation about "graduating", than if your child will be 18 & still in High School you have to continue to pay. You pay until he graduates or he turns 19.
Please note that after child support ends, your ex (and/or child) can ask a Judge for you to pay for additional education (College or a Professional Schooling). It is entirely discretionary on the part of a Judge but it seems to be fairly common.
Personally I find it bogus that an ADULT can be forced to pay for another ADULTS education. A married couple (who didn’t divorce) has the option to NOT pay for their childs College education, so why is it that a divorced parent could be made to do so?
DCR..wrong..not all states require to pay for support or higher education once they turn 18.
my state does not.
why do kids think their parents owe the college?
If you’re cutting a check each month, or sending a payment from your bank, just stop paying when you’re done.
If it’s being withheld from your paycheck, you need to ask your payroll department if the order they got from the court has a certain date to stop withholding (and call that to their attention so they’ll do it when it comes time). If there’s no firm date, ask the payroll department if they need something signed by the judge to stop the withholding, and if so, ask your divorce lawyer to get that form to the judge.
